Terms & Conditions:
The Walt Disney Company is not a so-called “sponsor,” “administrator” or “prize provider.” The Walt Disney Company, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, illnesses, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize travel package, the receipt, use and/or enjoyment of the prize travel package, or prize-related activity including, without limitation, travel, the promotion, the competition, the contest or the sweepstakes. Prize Draw Terms & Conditions Promoter 1. The promoter is Primark Stores Limited, with its registered office at Weston Centre, 10 Grosvenor Street, London, W1K 4QY, UK. All references to “Primark”, in these Terms and Conditions refer to Primark Stores Limited. Applicable Terms 2. Once you have opted-in to enter the Promotion, you will then be given the opportunity to confirm that you have read and agree to be bound by these Terms and Conditions. 3. Please read fully the terms and conditions contained within this document which apply to this Promotion prior to entering the Promotion. How to Enter 4. To be eligible to enter, entrants must be aged 18 years or over at the time of entry and must be resident in Great Britain. For the avoidance of doubt, entrants resident in Northern Ireland, the Channel Islands or the Isle of Man are not eligible to enter the Promotion. 5. The Promotion is not open to any of Primark’s affiliate companies, employees of Primark, their families, agents or anyone else connected with the Promotion. 6. To enter the Promotion, entrants must enter via the entry form at https://cloud.mail.primark.com/DisneyStitchJul2025 between 3rd July 2025 to 3rd October 2025 inclusive (the “Promotion Period”). To be entered into the Promotion, entrants must have validly submitted their entry before 23:59 on the last day of the Promotion Period. Entries submitted after the Promotion Period will not be valid and will not be entered into the Promotion. 7. The Promotion is free to enter and no purchase is necessary to enter. 8. Access to the internet is required to enter the Promotion. 9. Only one Promotion entry will be accepted per person. Joint submissions and entries on behalf of another person are not permitted. Incomplete, illegible, misdirected or late entries will not be accepted. Prize 10. In this Promotion Primark is offering entrants the chance to win the Prize Package. Primark does not accept any responsibility for any costs which are associated with the Prize which are not expressly included in the Prize and any other costs incurred are the responsibility of the winners. 11. The prize is subject to availability. The prize is non-refundable, non-transferable and non-exchangeable and there is no cash alternative offered. 13. Primark reserves the right to substitute the prize for an alternative prize of equal or greater value at its sole discretion should the specified prize become unavailable for any reason. How Winners are Selected and Notified 14. There will be 2 (two) winners. The winners will be randomly selected by a randomised computer process from all valid entries received within fourteen days of the end of the Promotion Period. The winners will be the first 2 valid entries drawn. 15. The winners will be contacted within seven working days of the date of the draw via email which will provide details on how the winners can claim the prize. Primark will attempt to contact the winners twice by email. If any winner declines a prize or fails to respond within fourteen days from the initial notification, they forfeit any right to the prize, at Primark’s reasonable discretion. 16. In the event a prize is not claimed, Primark will select a new winner from the same pool of entrants, and the process described above for contacting winners and accepting prizes will apply until the prize is accepted in accordance with clauses 14 and 15. 17. The prize will be sent via email to the winner's email address provided within seven working days of the winner accepting it. Other Terms and Conditions 18. Primark reserves the right to discount any inappropriate or offensive entries and to disqualify any entries if Primark reasonably believes that there has been an attempt to manipulate or tamper with the operation of the Promotion, including (but not limited to) entries that are a) automatically generated by computer; b) completed by third parties or in bulk; c) illegible, have been altered, reconstructed, forged or tampered with; or d) incomplete. Primark also reserves its right to exclude an entrant from participating in the Promotion if there is any reason to believe there has been a breach of these terms and conditions. Primark may require you to provide proof that you are eligible to enter the Promotion. 19. Entries that contain any offensive or inappropriate content including (but not limited to): obscene, indecent or pornographic content; (b) content liable to incite racial hatred or acts of terrorism; (c) violent content; (d) excessive profanity; (e) content that is harmful to minors in any way; or (f) content that is otherwise harmful, unlawful or illegal, will be deleted, and the individual's entry disqualified at Primark's sole discretion. 20. In the event of unforeseen and exceptional circumstances or exceptional circumstances outside its reasonable control, Primark reserves the right to, where it becomes necessary, amend, suspend or discontinue, temporarily or permanently, the Promotion and will give appropriate notice to entrants. 21. Entrants agree to be bound by the reasonable decisions of Primark, which are final in all matters relating to the Promotion. No correspondence will be entered into in respect of Primark’s decisions. 22. Save in the event of Primark’s negligence, Primark does not accept responsibility for network, computer or software failures of any kind and has no responsibility for lost, delayed or misdirected entries regardless of the cause. 23. Nothing in these terms excludes Primark’s liability for death or personal injury caused by its negligence or for fraud, or any other liability that Primark may not exclude by law. Subject to that, and save in the event of Primark’s negligence or that of its employees, Primark and its affiliates will not be liable for any loss expense or damage which is suffered or sustained in connection with the Promotion or accepting or using any prize, including any loss incurred as a result of any delay and/or failure to perform any obligation to the winner or other entrants that is caused by: a. technical problems of any kind which may limit or prevent any person's participation in the Promotion; b. any loss or damage arising from or in connection with the allocation or enjoyment of a prize; or c. any other events beyond Primark’s reasonable control that may cause the Promotion to be disrupted or corrupted or may lead to loss of, or damage to, the winner or to the prize. 24. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply. 25. Personal data relating to entrants will be used for the purpose of this Promotion and to update entrants' marketing preferences with Primark and will not be supplied to a third party for any other purpose. Personal data supplied during the course of this Promotion will only be processed as set out in the Primark Privacy Notice found here: https://www.primark.com/en-gb/privacy-statement 26. Without prejudice to its data protection obligations, Primark will make winners’ surnames and county of residence available on request by email to dataprotection@primark.ie in accordance with relevant local laws. Entrants shall, at or before the time of entry, have the right to object to all or some of their personal information being made available in accordance with this paragraph. You can object by emailing Primark at dataprotection@primark.ie 27. Primark may also be asked to provide the details set out in clause 26 to the UK’s advertising regulator, the Advertising Standards Authority (“ASA”). This use of winners’ data is necessary for Primark’s legitimate interests in complying with its regulatory obligations. Winners may also object to the disclosure to the ASA by emailing the same address, giving reasons. Primark will take these reasons into account if the ASA asks for the winners’ details. Please note, however, that Primark may nevertheless still be required to disclose this information to the ASA. This may happen where, for example, Primark is required to demonstrate that a valid award took place. 28. These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties agree that any dispute or action arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England. If you live in Scotland, you can bring legal proceedings in respect of this Promotion in either the Scottish or the English courts. If you live in Wales, you can bring legal proceedings in respect of this Promotion in either the Welsh or the English courts. |
